Welcome to ChatPNT! These Terms of Service ("Terms") govern your use of the ChatPNT application, website, and services (collectively, the "Service") provided by the ChatPNT Team ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these terms. In such a case, "you" and "your" will refer to that organization.

2. Eligibility You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Service. If you are under the age of 18, you may only use the Service with the consent and supervision of a parent or legal guardian. The Service is intended for consumer use. 3. Account Registration and Security To use certain features of the Service, you must register for an account. You agree to: a. Provide accurate, current, and complete information during the registration process (currently username and email address). b. Maintain and promptly update your account information. c. Maintain the security of your password and accept all risks of unauthorized access to your account. You are responsible for all activities that occur under your account. d. 4. Use of the Service a. Permitted Use: You agree to use the Service only for lawful purposes and in accordance with these Terms. The primary purpose of ChatPNT is for entertainment and general informational exchange.

b. Prohibited Use: You agree not to use the Service: i. In any way that violates any applicable national or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from Italy, the EU, or other countries). ii. For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way. iii. To send, knowingly receive, upload, download, use, or re-use any material which does not comply with these Terms. iv. To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation. v. To impersonate or attempt to impersonate the ChatPNT Team, another user, or any other person or entity. vi. To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm the ChatPNT Team or users of the Service or expose them to liability. vii. To decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code for the Service.

5. Content a. User-Generated Content: You are solely responsible for all messages, files, audio recordings, and other content you send, upload, or transmit through the Service ("User Content"). You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to your User Content and that your User Content does not violate any third-party rights (including intellectual property or privacy rights) or any applicable laws.

b. Content Generated by AI: The Service utilizes artificial intelligence to generate text, images, or other content ("AI Content"). You acknowledge and agree that: i. AI Content is probabilistic and may be inaccurate, incomplete, or offensive. You must evaluate the accuracy and appropriateness of any AI Content before using or relying on it. ii. We make no representations or warranties of any kind regarding the AI Content. The ChatPNT Team is not liable for any errors, omissions, or damages arising from your use of AI Content.

6. Intellectual Property Rights a. Your Content: You retain ownership of your User Content. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content solely for the purpose of operating, developing, and providing the Service to you.

b. Our Service: We and our licensors own all right, title, and interest in and to the Service, including all associated intellectual property rights. You may not use our branding, logos, or trademarks without our prior written consent.

c. Copyright Policy (DMCA): We respect the intellectual property rights of others. We will respond to notices of alleged copyright infringement that comply with applicable law. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information: (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (ii) a description of the copyrighted work that you claim has been infringed; (iii) a description of where the material that you claim is infringing is located on the Service; (iv) your address, telephone number, and email address; (v) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and (vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf. 7. Termination We may terminate or suspend your access to all or part of the Service, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through the account settings on your profile page.

8. Disclaimer of Warranties THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

9. Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE CHATPNT TEAM, ITS AFFILIATES, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM YOUR USE OF THE SERVICE.

10. Indemnification You agree to defend, indemnify, and hold harmless the ChatPNT Team, its affiliates, and its licensors, and their respective officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content.

11. Governing Law These Terms shall be governed and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.

12. Changes to Terms We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
